By accessing or using Tiksoo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.
Tiksoo is a phone line monitoring service that places automated test calls to phone numbers you provide, analyzes the audio using acoustic fingerprinting, and sends alerts when failures are detected. The Service is provided on a subscription basis.
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for:

We reserve the right to suspend or terminate accounts found to be in violation of these terms without prior notice.
You acknowledge that automated calls are subject to various federal and state regulations. You represent and warrant that your use of the Service complies with all applicable laws, including but not limited to the TCPA, FCC regulations, and any relevant state telecommunications laws. Tiksoo is not responsible for your compliance with such laws.
Paid subscriptions are billed in advance on a recurring basis. By providing payment information, you authorize us to charge your payment method for all fees incurred. All fees are non-refundable except as required by law or as otherwise stated in writing.
We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
The Service and its original content, features, and functionality are and will remain the exclusive property of Tiksoo and its licensors. Our trademarks may not be used in connection with any product or service without prior written consent.
We collect and process data in accordance with our Privacy Policy. By using the Service, you consent to such collection and processing. Call recordings used for fingerprinting are retained only as long as necessary to provide the Service and are not shared with third parties except as required to deliver the Service (e.g., Twilio for call placement).
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Monitoring results are provided for informational purposes and Tiksoo does not guarantee detection of all failures.
To the fullest extent permitted by law, Tiksoo shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our aggregate liability to you for any claims arising under these Terms shall not exceed the fees you paid to us in the three months preceding the claim.
Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or by posting a notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Texas for resolution of any disputes.
